The Court of Cassation has upheld a verdict from the Grand Criminal Court, affirming a 10-year temporary hard labor sentence for a man in his sixties.

The man was convicted of causing his wife's death through a violent altercation that ensued after he slapped her and kicked her, resulting in her head hitting a cupboard edge.

The court's decision found the husband guilty of the felony of fatal beating, penalized under 1/330 of the relevant penalties.

The married couple got into an argument when the accused discovered WhatsApp conversations and missed calls on his wife's phone. Among the messages was a request from the victim for a picture. The situation escalated as the accused physically assaulted his wife.

The victim was subsequently pushed into a bedroom where the beating continued. As a result, her head struck the cupboard and wall, causing her to collapse, lose consciousness and vomit.

Despite being taken to the hospital, her condition deteriorated rapidly, preventing her from providing a statement to the police.

A forensic examination revealed that the victim suffered a head injury and subdural bleeding, indicative of a traumatic impact with a rigid surface. The autopsy ruled out any preexisting medical conditions as causes of death.

Investigation of the victim's phone records confirmed the absence of immoral content and revealed three missed calls and a picture request from the number linked to the victim.

The Court of Cassation's ruling upheld the imposed penalty, asserting that it appropriately reflected the gravity of the crime.

The court stated that the verdict met all legal requirements, ensuring fairness, justification, and proportional punishment, in accordance with Article 274 of the Code of Criminal Procedure.
