The Court of Cassation upheld a ruling issued by the Grand Criminal Court to sentence a man to 15 years of labor for committing statutory rape against his 13-year-old cousin, while the accused’s wife was acquitted of the felony of rape and indecent assault.

The court stated that the accused, who was convicted in December 2022, would commit statutory rape against his cousin when the victim’s mother would leave her and her sister in the accused’s house so that he and his wife would watch over them while the mother was at work.

According to the court, since the beginning of 2021, the accused committed statutory rape 59 times, all with the victim's consent, and when her mother learned of what happened, she filed a complaint.

The Criminal Court criminalized the ‘felony of sexual intercourse with a female (unmarried) over 12 years of age but under 15 years of age,’ within the limits of Article 294/2, penalties repeated 59 times, and the felony of indecent assault within the limits of Article 398/2, penalties repeated 60 times.

The court decided to sentence the accused to 15 years of labor, and the fees were to be calculated from the date of arrest and included in the expenses.

The Criminal Court also decaled the accused's wife innocent from the two felonies of assisting her husband commit rape and indecent assault.

The Criminal Court also decided to refer the victim to the Irbid Juvenile Court to prosecute her for the crime of perjury within the limits of Article 214, according to what she stated in her testimony about the crimes attributed to the accused’s wife.

The victim had denied that the wife had helped the husband commit statutory rape and she denied that the wife knew what was going on. She also retracted her statements before the court when she stated that the accused did not know anything.
